Homable terms and conditions
Last updated: 6 September 2026
1. Operator, scope, and acceptance
Homable is operated by Yagut LTD, Vaja-Pshavela Avenue, Block VII, Bld. 8, Apt. 10, 0186 Tbilisi, Georgia, registration number 405127884, email dmytro@homable.de (“Homable”, “we”). Full provider information is in the Impressum.
These terms govern access to the Homable online platform by property owners, prospective buyers, and tenants. They are made available before account creation or any paid service. A user accepts them through the labelled acceptance control; merely browsing public pages does not create a paid contract.
The service is intended for persons aged 18 or older with legal capacity. Commercial agents and brokers may use it only with our express permission.
2. Platform role
Homable supplies technical tools for listing, discovering, and directly discussing properties and for optional verification, document, signature, reservation, and payment workflows. Unless expressly stated in a separate order, Homable is not a broker, notary, lawyer, financial adviser, lender, insurer, escrow agent, buyer, seller, landlord, or tenant. Property contracts are concluded between users. Mandatory notarial form for German real-estate purchases remains unaffected.
Verification badges indicate only that specified information or documents were checked at a particular time. They are not a guarantee of identity, title, solvency, property condition, or successful completion. Users must perform their own legal, financial, and technical due diligence.
3. Accounts and user obligations
Users must provide accurate, current information, control their email/telephone access, keep account access secure, and promptly report suspected misuse. One person may not impersonate another or operate deceptive accounts. Homable may require identity and ownership verification before enabling sensitive features.
Owners must have the right to advertise a property and must keep material listing facts accurate. Users must not disclose another person's data without authority. Uploaded material must not infringe rights or law.
4. Prohibited content and conduct
Users must not submit illegal, fraudulent, misleading, discriminatory, defamatory, threatening, privacy-invasive, or intellectual-property-infringing content; malware, spam, unauthorised advertising, scraping, security circumvention, manipulation, or conduct that endangers users or the service is prohibited.
Users retain ownership of their content and grant Homable a non-exclusive, worldwide, royalty-free licence to host, reproduce, technically adapt, and display it only as needed to operate and present the service. The licence ends when content is deleted, subject to backups, legal retention, evidence, and content already lawfully shared.
5. Content moderation and DSA information
Homable may detect, review, restrict, demote, or remove content and may warn, suspend, or terminate accounts where reasonably necessary to enforce these terms or law. Measures consider the nature, severity, frequency, context, and consequences of the conduct. Automated signals may support fraud, security, duplicate, or prohibited-content detection.
Where required, affected users receive a clear statement of reasons and information about internal complaint and legal redress, unless notice is prohibited or would undermine safety or an investigation. Complaints and notices of alleged illegal content may be sent to dmytro@homable.de with the URL, explanation, and contact details. We review them impartially and without undue delay.
DSA contact point for authorities and users: dmytro@homable.de. Supported languages: German and English.
6. Ranking and recommendations
Search and discovery primarily use the user's filters, location relevance, price/property criteria, and recency. Paid ranking must be clearly labelled. Homable does not currently use solely automated decisions with legal or similarly significant effects.
7. Third-party services
Features may rely on Supabase, Veriff, Dropbox Sign, PayU, Mapbox, communications providers, and other identified suppliers. Their own terms and privacy notices may also apply. Homable remains responsible for its own obligations but does not control an independent provider's service. Users must review transaction documents before signing. An electronic workflow does not replace any legally required qualified signature, written form, or notarisation.
8. Prices, payments, and consumer information
Before any paid order, Homable will display the essential features, total price including taxes and recurring charges, payment method, term, termination conditions, and any applicable withdrawal information. No charge is owed unless the user expressly orders through a button clearly indicating an obligation to pay. PayU or another disclosed provider may process payment; Homable does not hold purchase prices, rent, or deposits unless a separate regulated arrangement expressly says otherwise.
9. Consumer withdrawal
Where a consumer has a statutory right to withdraw from a distance service contract, Homable will provide the legally prescribed withdrawal instructions and model form before contract conclusion. If a consumer expressly asks performance to start during the withdrawal period, statutory consequences apply. No wording here limits mandatory withdrawal rights. Notices may be sent to Yagut LTD at Vaja-Pshavela Avenue, Block VII, Bld. 8, Apt. 10, 0186 Tbilisi, Georgia, or dmytro@homable.de.
10. Availability, changes, and termination
We may maintain, update, secure, or discontinue functions and do not promise uninterrupted availability. Changes that materially disadvantage users will be communicated in advance where required. A user may close the account at any time, subject to transactions, legal retention, and claims. We may restrict or terminate access for material/repeated breach, fraud, risk, or legal necessity, with reasons and appeal where required.
Changes to these terms apply prospectively. Material changes will be notified on a durable medium or prominently in the service with a reasonable notice period, unless immediate change is legally or technically necessary. Continued use alone will not replace express consent where the law requires it.
11. Warranty and liability
Mandatory statutory warranty and liability remain unaffected. In particular, nothing excludes liability for intent, gross negligence, injury to life/body/health, product liability, guarantees, or other liability that cannot lawfully be limited. For slight negligence, Homable is liable only for breach of an essential contractual duty and only for foreseeable damage typical for the contract, to the extent legally permitted. Homable is not responsible for user statements or user-to-user performance merely because the platform carried the communication.
12. Privacy
Personal-data processing is described in the Privacy policy; device storage is described in the Cookie policy. Dmytro Grinshpun is the EU representative under Article 27 GDPR, email dmytro@homable.de.
13. Governing law and disputes
German law applies, excluding the CISG. For consumers, this choice does not remove mandatory protections of the country of habitual residence, and statutory jurisdiction rules apply. Any exclusive venue clause applies only where legally permitted, particularly to merchants rather than consumers.
Yagut LTD is neither willing nor obliged to participate in dispute-resolution proceedings before a consumer arbitration board under § 36 VSBG. The former EU ODR platform was discontinued on 20 July 2025 and is therefore not linked.
14. Languages, severability, and contact
The German and English versions are intended to express the same terms. For users contracting in German, the German version is the contractual version; mandatory consumer interpretation rules remain unaffected. If a provision is invalid, statutory law applies and the remainder stays effective. Users may not transfer an account; Homable may transfer the agreement only in accordance with law and without reducing mandatory rights.
