1. Scope and Acceptance of Terms

1.1 Overview

These Terms and Conditions ("Terms") govern your use of Homable, a beta-stage, free-to-use online platform for consumer-to-consumer (C2C) real estate listings in Germany. By accessing or using Homable (including browsing listings or creating an account), you agree to be bound by these Terms. If you do not accept these Terms, you must not use the platform.

Disclaimer: Pre-Commercial Beta Use

Homable is currently a private, non-commercial beta platform, operated for testing and evaluation purposes only. It is not operated by a registered company and does not offer commercial services as defined by § 5 TMG (German Telemedia Act).

The platform does not involve any paid features, monetization, or brokerage activity. No legal, financial, or real estate advice is provided. Use is entirely voluntary and governed by applicable Terms and Privacy Policy under GDPR and German law.

The site is intended to assess interest and functionality only and may be modified or taken offline at any time.

1.2 Operator Identification (Impressum)

Homable is operated by Nikita Mullovskii (the "Operator"). For legal purposes, the Operator's contact details are as follows (Impressum gemäß §5 TMG):

1.3 Non-Commercial, Beta Service

Homable is currently offered free of charge and in a beta phase. The platform may contain bugs or incomplete features, and its services or content may change, update, or be withdrawn at any time as we improve the platform. We will strive to maintain service availability, but no guarantee of uptime or performance is given during this beta period. By using Homable in its beta stage, you understand and accept that the service is provided "as is" without any warranties, and that features can be added, modified, or removed at our discretion.

1.4 Acceptance

By creating an account or using Homable, you confirm that you have read and understood these Terms and agree to abide by them. These Terms incorporate important rights and obligations under German and EU law (including the German Civil Code (Bürgerliches Gesetzbuch -- BGB), Telemediengesetz (TMG), EU General Data Protection Regulation (GDPR), Digital Services Act (DSA), and Verbraucherstreitbeilegungsgesetz (VSBG)) to ensure a safe, transparent, and fair service for users. If you do not agree with any provision of these Terms, you should refrain from using Homable.

2. Homable Service Description

2.1 Platform Role

Homable provides an online platform that allows both private individuals and company-owners (together, "property owners") to list real estate properties (such as homes or apartments for sale or rent). Other users may browse these listings and directly connect with property owners to explore, negotiate, and conclude real estate transactions.

Homable's role is strictly limited to providing the technical infrastructure that facilitates this connection. Homable is not a real estate broker, intermediary, agent, escrow provider, or party to any contract formed between users. It does not mediate transactions, give legal or financial advice, or assume any responsibility for the accuracy of listings or the success of negotiations between users.

Property owners -- whether individuals or companies -- must provide sufficient documentation to verify their legal ownership of the property listed. Homable reserves the right to request, review, and validate such documentation (e.g. land registry title, company registration documents) and may remove or suspend listings that fail to meet verification standards.

2.2 No Brokerage or Agency

Homable is not a real estate broker or agent, and no brokerage services are provided. We do not act as a real estate agent, property broker, or escrow agent for any transaction on the platform. Homable does not charge commissions, find buyers or tenants on your behalf, negotiate deals, or enter into contracts for you. We do not represent either party in a property transaction and we do not perform any activities that would require a real estate brokerage license. Our service is limited to providing a platform for users to meet and exchange information. All contract formation, negotiations, and transaction decisions are solely the responsibility of the users involved in a potential deal.

2.3 No Contractual Involvement

Any sale, rental, lease, or other property agreement you enter into through contacts made on Homable is exclusively between the users (property owner and prospective buyer/tenant). Homable is not a party to those contracts, and no contractual obligations or rights regarding the property arise for Homable. We do not guarantee that users will complete a transaction, that any agreement between users will be valid or enforceable, or that parties will fulfill their obligations. Users must perform their own due diligence and risk evaluation for each prospective deal -- Homable plays no role in evaluating the suitability or legitimacy of any property or counterpart.

2.4 No Advice or Escrow

Homable does not provide legal, financial, or real estate advice. Any information on the platform (including blog posts, guides, or user forums) is for general informational purposes only and should not be relied upon as professional advice. Users are encouraged to seek professional advice (legal, financial, technical inspections, etc.) before entering into any real estate transaction. Homable also does not provide escrow or payment holding services. We don't take possession of purchase money, security deposits, or rent on behalf of users. (See Section 7 regarding payments via third-party providers.)

2.5 Beta Features

As a beta service, Homable may introduce new tools or experimental features (such as identity verification, document uploading, digital contract signing, etc.) on a trial basis. We reserve the right to modify or discontinue any beta feature at any time. We do not guarantee that beta features will work correctly or be available to all users, and user data related to beta features may not be preserved long-term. Feedback: We welcome user feedback on beta features to help improve the platform.

3. Eligibility and User Accounts

3.1 Eligibility Criteria

To register and use Homable, you must meet the following conditions: (a) You are at least 18 years old and have full legal capacity to enter into contracts; (b) You are registering as a private individual (consumer) seeking to list or find properties for personal use (not as a commercial real estate agent or business)*; (c) You have not been prohibited by Homable from using the service in the past (e.g., due to prior violations of these Terms).

Homable is intended for direct owner-to-seeker transactions. Real estate agents or other commercial intermediaries are not permitted to list properties on Homable without our explicit consent. Homable reserves the right to reject or remove listings that appear to be placed by agents or businesses, in order to maintain a consumer-to-consumer focus.

3.2 Account Registration

To use Homable, you must register with a valid email address and provide accurate, current, and complete information, including your full name. Homable uses a passwordless login process: we will send a secure one-time login link or verification code to your email address to authenticate your access.

You agree to keep your email account secure, as it serves as the primary access point to your Homable account. You are responsible for all activity occurring under your account unless you have promptly reported a suspected security breach to us.

Each user may register only one account, unless explicitly authorized by Homable. Creating or managing multiple accounts without permission may result in suspension. You agree not to impersonate others, misrepresent your identity, or provide false information during registration or use of the platform.

3.3 Account Approval and Verification

Homable may request additional verification steps before approving or enabling certain user actions. For trust and safety, identity verification is required in the following cases:

  • When a user attempts to publish a property listing (as an owner)
  • When a user applies for or expresses interest in a listed property (as a seeker or buyer)

Homable uses a trusted third-party service, Veriff, to conduct secure identity verification. You may be asked to upload a government-issued ID and perform a facial scan to confirm your identity. By proceeding with these actions, you consent to this verification process.

To verify property ownership, Homable also requests relevant documentation such as ownership title extracts or land registry documents. These are reviewed manually for a basic name match with your verified identity.

Verification is for platform safety purposes only. It does not constitute a guarantee of ownership, identity, or trustworthiness, and does not replace the need for users to conduct their own due diligence.

All verification data is handled securely and in accordance with our Privacy Policy and applicable data protection laws.

3.4 Account Use and Security

You must use your own account and not share login credentials with others. You agree not to impersonate any person or entity or misrepresent your identity or affiliations. You must also ensure the security of your login credentials; Homable will not be liable for any loss or damage arising from unauthorized use of your account resulting from your failure to safeguard your credentials. We may suspend or terminate accounts that we reasonably suspect are involved in impersonation, fraud, or other misuse.

3.5 Account Suspension or Deletion by User

You may delete your Homable account at any time if you no longer wish to use the service. See Section 11.2 on Right of Withdrawal for conditions applicable to consumer users. Account closure will result in removal of your profile and listings from public view, though certain data may be retained as required by law or for legitimate business purposes (see Section 8 on data retention).

4. User Responsibilities and Acceptable Use

4.1 Accurate Listings and Content

If you list a property on Homable, you must be the property owner or have the owner's lawful authorization to list and eventually sell or rent out the property. You are responsible for ensuring that all information in your listings is truthful, current, and not misleading. This includes details like property description, price, location, size, features, and any other relevant terms. Do not omit any material facts that a typical buyer or tenant should know. If circumstances change (for example, the property is sold or no longer available), you agree to promptly update or remove the listing.

4.2 Listing Rights and Permissions

By posting a listing or any content on Homable (including text, photographs, videos, documents, or other materials), you confirm that you own or have obtained all necessary rights and permissions to that content. For example, you should only upload photos you took yourself or have permission to use, and any description or documents (floor plans, certificates, etc.) must be yours to share. You must not post personal data of third parties (such as a tenant's information or another owner's details) without their consent. You retain ownership of the content you post; however, you grant Homable a non-exclusive, worldwide, royalty-free license to use, reproduce, display, distribute, and adapt your content on the Homable platform and in related promotional materials. This license is solely for the purpose of operating and marketing the Homable service and ends when you remove the content or delete your account (with the exception that archived backups or references may persist for a limited time).

4.3 Prohibited Content and Activities

You agree not to post or transmit any content or engage in any activity on Homable that:

  • Violates Laws or Rights: is illegal under applicable law, fraudulent, or infringes upon the rights of others (including intellectual property rights, privacy rights, or contractual rights). This includes posting properties that you have no right to sell/rent, or using images/text you copied without permission.
  • False or Misleading: contains false information, deceptive claims, or omits important facts in a way that misleads others. All listings and user profiles should be honest and transparent.
  • Offensive or Harmful: is defamatory, abusive, harassing, threatening, or discriminatory (e.g., content that constitutes hate speech or unlawful discrimination). Real estate listings must comply with anti-discrimination laws -- for instance, you may not state buyer/tenant preferences that exclude protected groups.
  • Security Risks: contains viruses, malware, or any code intended to harm or hijack the operation of the platform or other users' devices.
  • Spam or Unsolicited Offers: constitutes unsolicited or unauthorized advertising, promotional materials, junk mail, spam, pyramid schemes, or any form of solicitation not related to a bona fide property listing. You should not use Homable to advertise services or products, nor to harvest user information for commercial purposes.
  • Impersonation: impersonates any person or entity, or falsely states or misrepresents your affiliation with a person or entity. You may not create accounts under someone else's name or create multiple false accounts.
  • Interference with Platform: attempts to interfere with or disrupt the platform's normal operation. This includes circumventing any security or access controls, scraping or mining data from the site (beyond what is allowed via public interfaces), launching any automated system (like bots or scripts) to access the service in a manner that sends more requests than a human could reasonably produce, or otherwise impairing the stability or integrity of Homable.

You agree not to upload, post or transmit any content (including listings or comments) that is unlawful, defamatory, infringing, fraudulent, hateful, sexually explicit, or otherwise violates any law or these Terms. In particular, content that violates intellectual property rights, privacy rights, or is otherwise illegal is strictly forbidden.

(These use restrictions are clearly articulated here in compliance with EU Digital Services Act requirements, to ensure a safe and fair online environment.)

4.4 Content Moderation and Platform Enforcement

Homable reserves the right to review, edit, or remove any content posted on the platform that we determine, in our sole discretion, violates these Terms or applicable laws, or is otherwise objectionable. We are not obligated to pre-screen content, but we may employ automated tools and human moderators to monitor postings for violations. Homable may also suspend or terminate your account if you violate these Terms (see Section 10 on termination). We will normally notify you if we remove your content or suspend your account, including the reason for the action, unless we are legally prevented from doing so or if giving notice could result in liability or harm to someone.

Homable complies with the EU Digital Services Act. We reserve the right to remove or restrict access to any user-generated content or listing that violates these Terms or applicable law (e.g. illegal or infringing material). Any user whose content or account is affected will be notified of the action and the specific reasons and legal basis for it. Affected users may appeal removal or suspension decisions via our internal complaint handling mechanism, and we will inform them of available redress options (such as out-of-court dispute resolution or judicial remedy). We also make our content moderation policies and any automated tools used for moderation publicly available in clear language, as required.

4.5 Misuse Policy and Consequences

To ensure a trustworthy platform, Homable maintains a Misuse Policy as part of these Terms. If a user engages in prohibited activities or otherwise misuses the platform, Homable may take one or more of the following actions:

  • Warning: Issue a warning outlining the violation and required corrective action.
  • Content Removal: Remove or hide the offending content (listing, comment, etc.) either temporarily or permanently.
  • Temporary Suspension: Suspend the user's account access for a defined period (e.g. 7 days or 30 days), during which the user cannot log in or use Homable.
  • Permanent Ban: Terminate the user's account and prohibit re-registration, for severe or repeated violations.

The duration of suspensions will depend on the severity and frequency of the violation -- serious misconduct or illegal activity may result in immediate permanent ban, whereas minor first-time infractions might merit a warning or short suspension. In assessing misuse, we consider factors like the harm caused, whether the act was intentional, and previous compliance history. We will inform users of the suspension duration and any steps they may take to appeal or resolve the issue.

4.6 Internal Complaint Resolution

If you believe content was removed or your account was suspended in error, or you have any dispute with an enforcement action Homable took, you have the right to an internal complaint handling process. You may contact us at dmytro@homable.de (or via any designated contact form) with the details of your complaint. Please include any relevant information or evidence. Homable will review your complaint in good faith and provide a response or resolution within a reasonable timeframe. This internal complaint mechanism is provided in accordance with the Digital Services Act requirements and does not prejudice any statutory rights or remedies you may have.

4.7 Recommender System Transparency

Homable aims to present listings in a neutral and user-friendly manner. Listings search results are primarily ordered based on user-selected criteria (such as filters for location, price range, property type) and by default may be sorted by date (newest listings first). We currently do not use personalized algorithms to target specific listings uniquely to individual users beyond their explicit search filters. All users using the same search parameters will generally see similar results. Homable does not allow paid placement or promoted listings that would unfairly influence the order of results. (This disclosure of our content presentation parameters is provided to comply with transparency obligations, even though Homable's system is simple and user-driven.)

4.8 User Interaction and Messages

Users may have the ability to communicate with each other through Homable's messaging system or contact details provided in listings. You agree to use such communication tools only for genuine interest in the property (e.g. to ask questions, arrange viewings, negotiate terms). It is prohibited to send threats, harassment, or marketing messages to other users. Homable does not routinely monitor private communications between users, but reserves the right to access and review messages if a user reports abusive behavior or we have reason to believe the messaging system is being misused in violation of these Terms or the law.

4.9 User Indemnity

You are solely responsible for all content and actions you take on Homable. You agree to indemnify and hold Homable (and its Operator, affiliates, and personnel) harmless from any claims, liabilities, damages, losses, or expenses (including reasonable attorney's fees) arising out of or related to: (a) your use or misuse of the platform; (b) your breach of these Terms; (c) any content you post (such as claims that content infringes third-party rights or caused harm); or (d) any transactions or disputes between you and other users. This indemnification obligation will survive termination of your account or these Terms.

5. Listings, Verification, User Content, Pre-Qualification Request and Mandatory Verification

5.1 Property Listings

When you post a property listing, you must provide all the required details in the form provided by Homable. Mandatory fields might include property address or approximate location, type of property, size (e.g. square meters), number of rooms, price or rent, any fees, availability date, and other key details. You should also include clear videos, photos and may include documents (like floor plans, energy certificates and other) as allowed. By submitting a listing, you agree that Homable may make that information publicly available on our website for all visitors to see, and possibly share it on Homable's social media or partner sites for promotional purposes. Do not include sensitive personal information in your public listing description (such as your full name, phone number, or email) beyond what Homable specifically asks -- initial contact between interested parties can be made via Homable's pre-qualification request system to protect your privacy.

5.2 Verification of Listings

To support trust and minimize fraud, Homable requires identity verification for all users who list a property. Identity checks are conducted through our external provider Veriff, which securely verifies your government-issued ID and facial scan. Additionally, we request proof of ownership (e.g., land registry excerpts or title deeds) to manually validate that the listing party is the property owner. Listings that complete both identity and ownership verification may display a "Verified Owner" badge. This badge indicates that Homable has reviewed the submitted documents and that they appeared valid at the time of review. If you undergo verification, you agree to provide accurate information and documents. Homable will process and store such data in compliance with GDPR (see Section 8).

Verification Badges: If a listing or user is marked as verified (e.g., with a "Verified Owner" badge), this indicates only that Homable has reviewed the provided documents and they appeared valid at the time of review. Homable does not guarantee that a verified listing is free of risk, that the person is unquestionably the owner, or that the property is as described -- it is simply an added measure of trust. All users should still exercise caution and conduct their own checks (for instance, viewing the property in person, checking legal title via a notary, etc.). Homable disclaims any liability for losses related to reliance on a verification badge, as verification is provided on a best-effort basis for user convenience.

Verification is performed exclusively for platform safety. It is not a legal guarantee of ownership, nor a substitute for independent checks. Homable does not warrant that a verified listing is risk-free, nor that the owner is fully and unquestionably entitled to sell or rent the property.

All users are responsible for conducting their own due diligence, including in-person viewings and legal validation (e.g., via a notary or lawyer) before entering into any agreement.

5.3 Editing and Removing Listings

You may edit or remove your property listing at any time through your account dashboard. Homable also reserves the right to unilaterally remove or hide listings that are outdated (for example, a listing that is several months old with no activity) or that we have reason to believe violate our Terms or are no longer valid. We will try to notify you if we remove your listing (e.g., due to suspected violation or complaint), and you will have an opportunity to correct any issues or appeal our decision via the complaint mechanism in Section 4.6.

5.4 No Endorsement of Content

Homable does not endorse or guarantee any user-generated content, including listings. While we may, at our discretion, verify certain elements as described above or moderate content, the responsibility for the content lies with the user who provided it. Homable is simply a host for that content and is protected by the liability safe harbor for hosting services under EU/German law (e.g., §10 TMG), which means we are not liable for user content that we have no knowledge of being unlawful. If we are notified of illegal content, we will act expeditiously to remove or disable access to it.

5.5 Reporting Misconduct or Issues

If you believe any content on Homable (such as a property listing or user profile) is inaccurate, fraudulent, or violates these Terms or the law, please report it to us. You can use the "Report" feature (if available on a listing) or send an email to dmytro@homable.de with details of the issue. Homable will review such reports promptly. In cases of alleged illegal content or serious violations, we may suspend the content and contact the uploader for a statement, in line with applicable notice-and-takedown procedures. We may also, at our discretion, inform you of the outcome of your report, especially if you are directly affected (for instance, if you reported someone impersonating you).

5.6 Pre-Qualification Request and Mandatory Verification

To request a property viewing, apply for a listing, or submit an offer, all potential tenants and buyers must complete a pre-qualification request form and verify their identity via Homable's external identity verification partner, Veriff.

By completing the form, you consent to Homable collecting the required personal and financial data and, with your explicit consent, securely sharing it with the property owner or authorized representative of the listing. You confirm that all data submitted is accurate, current, and provided in good faith. Homable is not responsible for the outcome of any application or for inaccurate or incomplete information submitted by users.

Pre-qualification data may include (depending on context):

  • Verified identity details via Veriff (first name, last name, ID status, date of birth, document address)
  • Employment and income information (employer, job title, payslips, bank statements, supporting documents)
  • Financial situation and purchase or rent readiness (down payment proof, financing status, SHUFA, savings declaration)
  • Lifestyle or rental history data (family status, pets, interests, eviction or late payment history, landlord references)

A complete list of pre-qualification fields for buyers and tenants is shown to users in the application interface.

Providing this information is mandatory for interaction with listings and helps owners assess compatibility and reliability. Homable only facilitates the data transfer and does not review, score, or endorse the information. Decisions remain solely with the listing owner.

All pre-qualification data is processed in accordance with GDPR and our Privacy Policy. Users may withdraw consent or request data deletion at any time via their account settings or by contacting support.

5.7 Letter of Intent (LOI) Signing

Homable provides a standard Letter of Intent (LOI) template to help users formally express mutual interest in a potential real estate transaction. The LOI is intended as a non-binding, exploratory document unless the parties explicitly choose to make specific terms binding. Users can auto-fill the LOI using information they've provided and electronically sign it through Homable's integrated partner, Dropbox Sign.

Homable's role is strictly technical:

  • Homable is not a party to the LOI
  • Homable does not store or transfer funds, act as a mediator, agent, or legal advisor
  • Homable does not review or validate any LOI content or attachments

The LOI is a user-generated document. Any rights, obligations, or legal enforceability arise solely between the signing parties. Users are strongly encouraged to seek independent legal advice before signing, especially if they intend to make any part of the LOI binding (e.g., confidentiality, exclusivity, timelines).

Homable assumes no liability for any misunderstanding, dispute, or transaction outcome arising from the use of the LOI feature. The document is offered as a convenience tool only.

5.8 Rental Contract Signing

Homable offers a standard residential rental contract template to help parties document rental agreements efficiently. The template is based on commonly used formats in Germany and is designed to be auto-filled with submitted user data and signed via our integrated electronic signature partner, Dropbox Sign.

The rental agreement is a private contract directly between the landlord and tenant. Homable is not a party to the contract, and does not act as an agent, mediator, legal advisor, or notary. The contract template is provided solely as a convenience tool, and Homable does not review, customize, or validate its legal accuracy or suitability for individual use cases.

Users are strongly encouraged to:

  • Review the contract terms thoroughly before signing
  • Add or adapt clauses as needed for their specific situation
  • Seek independent legal advice if they are unsure about any obligations, rights, or enforceability

Important Legal Notice: If the agreed rental term exceeds 12 months, German civil law (e.g. §550 BGB) requires the contract to be signed in physical form or with a qualified electronic signature (QES). At the moment Homable does not provide QES functionality, and therefore electronic signing alone may not meet the legal form requirement for such contracts. In such cases, parties must also print and physically sign the rental agreement to ensure it is enforceable.

Homable disclaims any liability for:

  • The legal sufficiency or enforceability of rental contracts signed via the platform
  • Incomplete or invalid contracts
  • Disputes or damages arising from use or misuse of the template or signature tool

5.9 Document Exchange and Guidance

Homable may suggest helpful documents to upload during the property process (e.g. title deed, SHUFA, energy certificate, floor plan). The platform offers secure document exchange tools so that owners and seekers can share such documents directly, including those commonly required for mortgage applications or notary preparation.

Documents remain confidential and are not shared without user action or consent.

5.10 Sharing with Mortgage or Notary Partners

With your explicit consent, Homable may forward your submitted documents and pre-filled profile to a trusted mortgage partner (e.g., to initiate financing) or to a notary partner (e.g., to prepare a preliminary sale agreement).

You will always be informed before this occurs and must confirm your consent via a clear opt-in. Homable does not modify or evaluate these documents -- it simply transfers them to the requested partner to facilitate the user's process.

Homable is not responsible for the services of any third-party provider and disclaims liability for errors, omissions, or outcomes arising from such onward sharing.

5.11 Preservation of Statutory Liability

Notwithstanding anything else in these Terms, no exclusions of liability shall apply to the extent prohibited by law. In particular, our disclaimers do not exclude or limit liability for fraud, gross negligence, or for any personal injury or death caused by our negligent act or omission. Similarly, any statutory consumer rights under EU law (e.g. the right to contract performance or remedies for defective products) remain fully applicable.

6. No Agency and Disclaimers

6.1 No Agency or Partnership

Your use of Homable does not create any form of agency, partnership, joint venture, employer-employee, or franchisor-franchisee relationship between you and Homable. Homable does not act on your behalf in any capacity -- we are not your representative or broker. Similarly, users (owners and seekers) are independent parties; Homable does not represent any user.

6.2 User Responsibility for Deals

Homable is strictly a neutral venue. We do not direct or control users' negotiations or transaction terms. Any real estate sale or rental agreement is concluded solely between the parties involved. You are solely responsible for assessing the other party and the property. Before signing a contract or making any payment, you should conduct thorough due diligence: for buyers/tenants, this may include viewing the property, verifying the owner's identity and ownership documents, reviewing property condition or obtaining inspections, and reading all contract terms. For sellers/landlords, this may include vetting the buyer's/tenant's identity, creditworthiness, and seriousness. Homable will not intervene in disputes between users (e.g., contract deposit disagreements, property condition issues, fraud); we may, however, provide general guidance or support contact information if possible.

6.3 Third-Party Services and Advice

Homable may from time to time partner with third-party service providers (such as mortgage brokers, notary appointment services, moving services, or legal document providers) to offer you convenient links or integrated options. While we aim to partner only with reputable providers, Homable does not guarantee or endorse any third-party services. If you choose to engage with any third-party service (whether through a link on Homable or recommended in our content), that relationship is solely between you and the third-party, under their terms and privacy policies. Homable is not liable for any issues arising from third-party services. Likewise, any advice, tips, or information (legal, financial, or otherwise) that may be available on Homable (for example, in FAQ sections, articles, or AI-driven Q&A) are general in nature and not specific to your situation. 6.4 Open Beta Disclaimer

Given Homable's beta status, you acknowledge and accept that software bugs, glitches, and errors may occur. The platform may not be fully tested or free from inaccuracies. Homable is not liable for any losses or inconvenience caused by technical issues, such as downtime, data loss, message delivery failures, mapping errors in property location, or any feature not functioning as intended. We strongly encourage you to keep backup copies of any important information (e.g., text of your listings or messages) that you input into Homable, as data could be lost or reset during the beta phase.

6.5 Changes to Service

Homable reserves the right to make changes to the platform's functionality, design, or features at any time. We may also impose usage limits (for example, limit the number of listings a user can post, or the number of inquiries one can send in a day) as needed to maintain service quality. Significant changes that impact how you use the service will be communicated where possible (for instance, via an email or a notice on our website). If you object to any change, your only remedy is to stop using Homable. Continued use of the platform after changes are implemented signifies your acceptance of those changes.

In addition to posting updates on our site, we will notify users of any significant changes to these Terms of Service by email or other direct communication, in compliance with the EU Digital Services Act's requirements to inform recipients of major changes.

7. Payments and Transactions

7.1 Free Platform Use

Using the Homable platform is currently free of charge during its beta phase. Homable does not charge any service fees or commissions to users for core features, which include:

  • Creating and managing a user account
  • Browsing and searching property listings
  • Posting standard listings as an owner (including uploading photos, documents, and descriptions)
  • Completing identity and ownership verification (where applicable)
  • Requesting viewings and submitting pre-qualification profiles
  • Sending and receiving messages via Homable's communication tools
  • Signing Letters of Intent or rental agreements via integrated Dropbox Sign (excluding Dropbox's own commercial terms)
  • Using guidance tools and templates (e.g. contract templates, pre-filled forms, educational suggestions)
  • Using secure document exchange for property or financing documentation
  • One-click consent-based data sharing with mortgage or notary partners

If Homable introduces any paid services or features in the future -- such as premium listing options, featured placement, payment facilitation services, or document certification tools -- we will clearly notify users in advance, update these Terms, and provide an opportunity to accept or decline the new terms or services.

7.2 Direct Payments Between Users

Since Homable itself is not a party to transactions and does not provide escrow, any payments related to a property transaction (purchase price, rent, security deposits, etc.) are to be arranged directly between the buyer and seller or landlord and tenant. At this time, Homable does not process or intermediate those funds. We strongly advise users to exchange payments only through safe and documented methods (for instance, bank transfers or other traceable means) and to be wary of fraud (do not send money to a party you have not met or verified). Homable doesn't ask you to send money to us or through us for any transaction between users.

7.3 Future Payment Processing via Licensed Provider

Homable is preparing to integrate a secure payment feature to support certain transaction steps -- such as reservation deposits. When launched, all monetary transactions will be processed exclusively through a licensed third-party payment service provider (PSP) authorized to operate within the European Union.

Homable will not receive, hold, or manage any user funds directly. Instead, the PSP will facilitate secure transfers between users, or temporarily hold funds where applicable (e.g. in escrow), in accordance with EU financial regulations and payment industry standards.

7.4 Terms for Payment Services

Once the payment system becomes available, users who choose to use it may be required to agree to the payment partner's own terms of service and, where necessary, create an account with that provider. All transactions processed through the Homable interface will be governed by both these Homable Terms and the third-party PSP's conditions.

Homable will clearly inform users of any applicable fees, payment flows, or conditions at the time of launch. Homable does not currently charge any fees related to payment processing, and any PSP-related costs would be disclosed transparently at the point of transaction.

7.5 No Cash Handling

Homable will never ask you to mail cash, nor should you hand over cash to any Homable staff (in the event we organize an in-person event) for any property transaction. All financial dealings for real estate contracts should occur either through regulated channels (like bank transfers or the upcoming PayU system) or under the guidance of professionals (for example, in a property sale, typically a notary in Germany will manage the payment and title transfer process). We remind users that under German law, property sales must be notarized; any deposit or payment towards a purchase is typically handled in the context of that notarized contract process. Homable's role is only to help you reach the stage of agreeing on terms; the formal closing of a sale will be off-platform.

7.6 No Liability for Payment Issues

Since payments are outside Homable's current scope (and even once PSP is integrated, payments are handled by PSP), Homable is not liable for any payment disputes, chargebacks, fraud, or losses that occur between users. For example, if a tenant pays a deposit directly to a landlord and the landlord fails to refund it despite not executing the lease, that dispute is between those parties. Homable may, at our discretion, assist with providing user information or communication logs to the extent legally permitted to help resolve a dispute, but we do not mediate financial disagreements. Be cautious and only transact with trusted parties.

8. Privacy and Data Protection

8.1 General

Protecting your personal data is very important to us. Homable collects and processes users' personal data in compliance with the EU General Data Protection Regulation (GDPR) and applicable German data protection laws. A comprehensive Privacy Policy is under development and will be made available soon, detailing all aspects of our data handling. In the meantime, this section provides the key information required for GDPR compliance regarding how we handle your data.

8.2 Data Controller

The data controller for personal data processed in connection with Homable is Nikita Mullovskii (contact details provided in the Impressum in Section 1.2). You can reach out via dmytro@homable.de for any privacy-related inquiries or to exercise your data rights. (If Homable appoints a Data Protection Officer or EU representative in the future, we will update this section accordingly.)

8.3 Personal Data We Collect

When you use Homable, we may collect and process the following categories of personal data, depending on your role (e.g. owner, seeker, or both) and the features you use:

1. Account Information When you create an account, we collect your name, email address and phone number. We use a passwordless login system (via email-based authentication) and do not store passwords. Optional profile data (such as avatar) may also be stored if you choose to provide it.

2. Listing Information When you submit a property listing, you may include personal data in the listing content (e.g. property address, availability date, pricing). We treat this data as voluntarily made public. You are advised not to include private contact details (phone number, email) in the listing description itself.

Supporting documents (e.g. floor plans, energy performance certificates, appraisal reports) may also contain personal data or property identifiers and are stored securely.

3. Identity Verification Data (via Veriff) If you undergo identity verification (required for property listings or pre-qualification requests), we use Veriff as a secure external identity verification provider. You may be asked to scan a government-issued ID and perform a biometric face check.

Please note:

  • Homable does not store or retain your ID documents or facial scans. These are processed directly by Veriff.
  • Homable only receives the extracted identity attributes (e.g. name, birthdate, nationality, document type, ID verification status, document address).
  • Homable does not share your ID documents with any third parties under any circumstance.

4. Ownership Documents (for Listing Verification) If you list a property, we may ask for proof of ownership such as title deeds, land registry excerpts, or similar documents. These are reviewed manually and stored securely for verification purposes but not shared externally unless you explicitly consent (e.g. for transfer to a notary partner or approved tenant or buyer candidate). Only the submitted document itself and ownership-relevant metadata are processed.

5. Financial and Employment Data (for Pre-Qualification) If you submit a buyer or tenant pre-qualification request, we may collect a wide range of data, including:

  • Employment details (job title, employer name, contract type, sector, LinkedIn URL)
  • Income and financial situation (net income, savings balance, SHUFA reports, uploaded proof of income or deposits)
  • Household composition and support (number of adults/children moving in, whether others contribute to rent, financial support received)
  • Rent history (prior landlords, missed payments, eviction disclosures)
  • Lifestyle-related details (pets, hobbies, voluntary introductions via text or video)

All such data is provided voluntarily for the purpose of presenting a profile to property owners. Homable does not independently verify or evaluate this information, and it is only shared with owners after your explicit consent.

6. Communication and Interaction Data We store messages sent via Homable's internal messaging system for delivery and moderation purposes. We may also retain communication you send us directly (e.g. support requests, feedback). Homable does not access or analyze private communications beyond what is necessary for safety or support.

7. Usage and Technical Data We collect technical and usage data to operate and improve the platform, including:

  • IP address and device/browser information
  • Timestamps of visits and actions
  • Page views, searches, listing interactions
  • Authentication and login attempts
  • Cookie identifiers (see below)

8. Cookies and Similar Technologies Homable uses cookies and similar technologies to:

  • Authenticate users and keep sessions active
  • Save preferences and language settings
  • Measure engagement and platform usage (via analytics tools such as Google Analytics)

You can manage your cookie preferences using our cookie banner and upcoming Cookie Notice.

8.4 Purposes and Legal Bases of Processing

We process personal data for the following purposes, under these legal grounds:

  • Providing the Service (Contractual necessity): We process your account, listing, verification, and communication data in order to operate and provide the Homable platform as requested by you. This includes, for example:

    • Displaying your property listings to other users
    • Enabling search, filters, and user matches
    • Delivering messages and pre-qualification requests between users
    • Hosting your documents and profile details
    • Facilitating access to features such as contract templates or secure document exchange

    The legal basis for this processing is Article 6(1)(b) GDPR, as the data is necessary for the performance of our contractual obligations to you under our Terms of Service.

  • Verification and Safety (Legitimate interests or Consent): To increase trust on the platform, we may process identification documents and other verification data (with your consent when you choose to undergo verification) to confirm identities or property ownership. We also monitor usage and communications for fraudulent or illegal activity and to enforce our Terms (e.g., detecting scams or spam) -- this is based on our legitimate interest in maintaining a safe platform (Article 6(1)(f) GDPR).

  • Communications and Support (Contractual or Legitimate interests): We will use your contact details to send service-related communications: confirmations, updates about features, security alerts, or changes to terms/policies (necessary for performing our services and keeping you informed). We may also respond to your inquiries and provide customer support using your data. Some communications not strictly required for service (like feedback requests or surveys) may be based on legitimate interests (improving our services).

  • Marketing (Consent or Legitimate Interests): Homable does not currently engage in any personalized advertising or third-party marketing, and we do not sell or share your personal data for marketing purposes. If we introduce optional services such as newsletters, product update emails, or personalized suggestions (e.g. listings you may like), we will do so either:

    • With your explicit consent under Article 6(1)(a) GDPR, or
    • Under legitimate interest (Article 6(1)(f) GDPR), provided such communications are minimal, relevant, and always include a clear opt-out.

    You can manage your communication preferences at any time in your Privacy Settings, where you can choose which types of marketing or product notifications (if any) you wish to receive. Every marketing email will also include an unsubscribe link for your convenience.

    We will update this Privacy Policy before introducing any such services.

  • Analytics and Improvements (Legitimate interests): We may use cookies and usage data to analyze how our platform is used, identify trends, and improve user experience (for instance, by measuring which features are popular or where users encounter errors). This is based on our legitimate interest in understanding and enhancing our service. Wherever feasible, we will use aggregated or anonymized data for analytics to avoid identifying individuals.

  • Legal Compliance and Protection (Legal obligation or Legitimate interests): We may process and retain personal data to comply with legal obligations (e.g., retaining records for tax, handling valid law enforcement requests) under Article 6(1)(c) GDPR. We also process data when necessary to establish, exercise, or defend legal claims and to protect the rights and safety of Homable, our users, or others (legitimate interest). For example, if we are investigating a breach of our Terms, we may review relevant user data as evidence.

8.5 Data Sharing and Recipients

Homable treats your personal data with care. We do not sell your personal data to third parties, and we only share it in the following clearly defined cases:

1. With Other Users (with Your Knowledge or Consent): Homable is a platform for real estate matchmaking, and some information must be shared with other users to enable this functionality. For example:

  • When you post a listing, the content (e.g. property details, price, photos, floor plan) will be publicly visible to all visitors.
  • Your first name, avatar, and general location may also be shown alongside your listing.
  • When you submit a pre-qualification form or contact a property owner, the information you provide (e.g. name, employment info, uploaded proofs) is only shared with the listing owner after your explicit consent.
  • Homable does not reveal your email, ID documents, or exact address to other users unless you voluntarily include them in your content.

2. With Trusted Service Providers (Processors): We use carefully selected third-party providers to help operate and improve Homable. These service providers may process your data on our behalf, under strict data protection agreements (GDPR Art. 28), and only for purposes we define. These may include:

  • Web hosting and infrastructure (e.g., AWS in the EU)
  • Email and messaging systems (e.g., notification delivery and support replies)
  • Analytics and performance tools (e.g., Google Analytics, subject to your cookie preferences)
  • Phone number validation services
  • Identity verification via Veriff: Homable never stores your ID document or biometric data. Veriff processes these directly, and Homable only receives extracted information (e.g. name, date of birth, verification result). Your original documents are never shared or forwarded to anyone else by Homable.
  • Electronic signature provider (Dropbox Sign): If you use Homable to sign a Letter of Intent or rental agreement, Dropbox Sign will receive the document and limited identity metadata (e.g. name, email) solely to facilitate electronic signing. Dropbox Sign acts as an independent processor and may retain documents per their own policies.
  • Secure document exchange tools: Documents you upload (e.g. title deed, income proof, rent certificate) may be securely stored and shared only with your explicit action (e.g. when applying for a property or sharing with a mortgage partner).

3. With Payment Partner (Anonymized Provider, Future Use): When Homable launches integrated payment features (e.g. for deposits or rental payments), transactions will be handled by a licensed third-party payment service provider (PSP). Homable will not receive, store, or manage user funds.

This licensed PSP will act as an independent data controller for payment-related data, such as names, payment references, and bank details. Use of the payment feature will be subject to the PSP's terms and privacy policy, which will be presented clearly at the time of use.

4. With Notary or Mortgage Partners (with Consent): If you opt in, Homable may transfer your uploaded documents and profile data (e.g. ID metadata, pre-qualification form, property documents) to a trusted notary or mortgage partner to help initiate a financing or contract preparation process.

This transfer will only occur with your explicit consent via a clear, one-time confirmation prompt. Homable does not evaluate or modify any shared content. The third-party recipient will act as a separate data controller for the received information.

Legal and Safety: We may disclose personal data to third parties if required by law or legal process, or if we have a good-faith belief that such disclosure is reasonably necessary to (i) comply with a legal obligation, request from authorities, or court order; (ii) enforce our Terms or other agreements; (iii) address fraud, security, or technical issues; or (iv) protect the rights, property, or safety of Homable, our users, or the public. For instance, if law enforcement provides a lawful subpoena for information regarding a fraudulent listing, we may be obliged to provide relevant user data.

Corporate Transactions: If Homable (as a project or company) is ever involved in a potential merger, acquisition, investment, or asset sale, user data may be transferred to or examined by the parties involved, under the condition that they continue to respect your personal data in a manner consistent with these Terms and the Privacy Policy.

8.6 International Data Transfers

Homable currently stores and processes all personal data on servers located within the European Union (EU). We use EU-based infrastructure providers (e.g., AWS Europe) to ensure that your data remains within the EEA and is subject to the full protections of the EU General Data Protection Regulation (GDPR).

We do not transfer your personal data outside the EU/EEA unless:

  • You explicitly request a service that requires such a transfer (e.g., cross-border communication), or
  • We use third-party tools that operate globally (e.g., email, identity verification, e-signing), in which case we ensure appropriate safeguards are in place in accordance with Chapter V of the GDPR (e.g., Standard Contractual Clauses (SCCs) or adequacy decisions).

Homable is committed to maintaining a high level of data protection, regardless of location.

8.7 Data Retention

We keep your personal data only as long as necessary for the purposes set out in these Terms or as required by law. Concretely:

  • Account data (profile info, credentials) is retained as long as you have an active account. If you delete your account or it's terminated, we aim to remove or anonymize personal data within a reasonable period, except where retention is required (e.g., keeping transaction records, if any, for tax or dispute purposes, typically 3-10 years as per legal obligations).
  • Listings and content you posted may remain visible on the site until you remove them or delete your account. Removed content might persist in backups or archives for a short duration but will be expunged on our regular cleanup schedule.
  • Communication logs (messages between users) are generally stored for at least the duration that the related listings are live and may be retained for a period after (for safety audits or user support needs). If you delete your account, messages you sent may still be retained as part of the recipient's inbox, or if needed for investigations.
  • Verification Documents: Homable does not store any government-issued ID documents, biometric data, or scanned identity files on its own servers. All identity verification is handled securely by our trusted third-party partner, Veriff. Veriff may temporarily retain your verification documents (such as ID scans) for the purpose of completing the verification process and meeting regulatory requirements. Homable only receives and processes non-sensitive extracted attributes from Veriff (e.g., name, ID type, ID number, document address, verification status). We do not upload, download, store, or share your original identity documents at any time. Homable works exclusively with the verified data output provided by Veriff. If you would like to know more about Veriff's data handling or request deletion of your verification records, you may contact them directly or reach out to us for assistance.
  • Analytics data may be stored in aggregated form indefinitely (without personal identifiers). Raw logs with IP addresses, etc., are typically rotated and deleted periodically, unless used in security analysis. We will include specific retention periods in the full Privacy Policy.

8.8 Your Rights under GDPR

As a data subject in the EU (or under equivalent laws if you are in a similar jurisdiction), you have various rights regarding your personal data that we respect and uphold:

  • Right of Access: You can request a copy of the personal data we hold about you, and information about how we process it.
  • Right to Rectification: You can ask us to correct inaccurate or incomplete personal data we have about you. (Much of your basic info can also be updated through your account settings.)
  • Right to Erasure: You can, in certain circumstances, have your personal data deleted (the "right to be forgotten"). For example, if you withdraw consent from a processing that had no other legal basis, or if data is no longer needed for the purposes it was collected. Note: complete deletion may not be immediate if certain data must be kept for legal reasons, but we will inform you if so.
  • Right to Restrict Processing: You can ask us to limit processing of your data in certain situations -- for instance, while a complaint about data accuracy or an objection to processing is being resolved.
  • Right to Data Portability: For data you provided to us and which we process by automated means on the legal basis of contract or consent, you have the right to request a common machine-readable format of such data, or have it transferred to another provider where technically feasible.
  • Right to Object: You may object to our processing of your data when it is based on legitimate interests, on grounds relating to your particular situation. You also have an unconditional right to object to use of your personal data for any direct marketing purposes (though as noted, we don't currently send marketing without consent).
  • Right not to be subject to automated decisions: Homable does not make any legally significant decisions about you purely by algorithms without human involvement. If that changes, you would have rights regarding such profiling/automated decisions, including the right to express your point of view and contest the decision.
  • Right to Withdraw Consent: In cases where we rely on your consent for processing (e.g., you consented to an optional feature or marketing), you have the right to withdraw that consent at any time. Withdrawing consent will not affect the lawfulness of processing done before the withdrawal.

To exercise any of these rights, please contact us at dmytro@homable.de. We may need to verify your identity before fulfilling certain requests. We will respond within one month, or inform you if more time is needed.

8.9 Right to Lodge a Complaint

If you believe our handling of your personal data infringes applicable data protection laws, you have the right to lodge a complaint with a supervisory authority (in particular, in the EU member state of your habitual residence, place of work, or place of the alleged infringement). For example, a German user can contact the Federal Commissioner for Data Protection (BfDI) or their state's Data Protection Authority. The contact details will be provided in our Privacy Policy. Of course, we encourage you to reach out to us first, and we will do our best to address your concerns.

8.10 Privacy Policy

These Terms provide a summary for immediate compliance, but they do not replace a full Privacy Policy. Homable's comprehensive Privacy Policy, once available, will contain further details on topics such as cookies and tracking, third-party services, data security measures we implement, and any country-specific provisions. If there is any conflict between this Section 8 and the Privacy Policy, the more protective or specific terms in the Privacy Policy will prevail for privacy matters. By using Homable, you acknowledge that you have read (at least) this interim privacy notice and consent to the processing of personal data as described, to the extent such consent is necessary.

9. Liability Limitations

9.1 Homable's Liability Framework

Homable will endeavor to operate the platform with reasonable skill and care, but usage of the platform is at your own risk. To the maximum extent permitted by applicable law, Homable's liability to you is limited as described in this section. Nothing in these Terms limits or excludes liability that cannot be limited by law, such as liability for intentional misconduct or gross negligence, for injury to life, body or health, or under the Product Liability Act (if applicable). However, Homable has no liability for ordinary negligence except as set forth below.

9.2 No Liability for User Conduct or Contracts

Homable is not liable for the actions or omissions of any user of the platform. We do not assume liability for any damage or loss arising from a transaction (or attempted transaction) between users. This includes, without limitation: financial loss, property damage, legal disputes, or personal injury that might occur in the course of property visits or transactions initiated through Homable. For example, if a buyer suffers a loss because a seller provided false information in a listing, or if a landlord fails to return a deposit, those matters are outside of Homable's control and responsibility. Any claims arising from such disputes must be made against the responsible user(s), not against Homable.

9.3 Third-Party Content and Links

The platform may contain content provided by other users or links to third-party websites/services. Homable is not responsible for third-party content (including its accuracy, legality, or completeness), nor for any third-party websites or services, even if accessed via our platform. If you leave Homable via a link, you should review that third party's terms and privacy policy. We do not endorse any linked site or service. You agree that Homable will not be liable for any loss or damage of any sort incurred as a result of your dealings with third parties.

9.4 Platform Availability

Homable strives to keep the platform up and running, but we do not guarantee continuous, uninterrupted access. Scheduled maintenance or unforeseen technical issues may make the site unavailable at times. We will, when possible, post advance notices for major maintenance downtime. Homable is not liable for any indirect or consequential damages resulting from downtime, lost data, or delays in operation or transmission. In the event of data loss or corruption, our liability (if any) would be limited to restoring the most recent backup available.

9.5 Limitation of Liability Amount

To the extent that Homable is found liable for any claim arising out of or relating to these Terms or the use of the platform (whether in contract, tort, or any other legal theory), our aggregate liability shall be limited to EUR 100 (Euro). If you are a consumer and the above cap is deemed unenforceable, then, to the fullest extent allowed by law, our liability will be limited to the direct damages you actually incur, excluding any indirect or non-material damages. We will not be liable for indirect, incidental, special, punitive, or consequential damages, including but not limited to lost profits, lost opportunities, lost data, or emotional distress, even if we have been advised of the possibility of such damages.

9.6 Liability for Slight Negligence

In case of Homable's simple or slight negligence (einfache Fahrlässigkeit), Homable will only be liable if it breaches a duty that is essential to the contract ("cardinal duty"), i.e., a duty whose fulfillment is a prerequisite for enabling the proper performance of the contract and on whose fulfillment you generally rely. In such cases (slight negligence in cardinal duties), Homable's liability is limited to the typical and foreseeable damage at the time of concluding the contract. We will not be liable for slight negligent breaches of any non-essential obligations or for slight negligence by auxiliary persons. This section is intended to be interpreted consistent with § 521 et seq. BGB and related provisions that limit liability for slight negligence.

9.7 No Warranty

Homable provides the platform "as is" and "as available". To the extent allowed by law, we disclaim any warranties and representations of any kind, whether express, implied, or statutory, including (without limitation) any warranties of title, non-infringement, merchantability, or fitness for a particular purpose. We do not warrant that the information on the platform is complete or error-free, nor that any property will meet your expectations, nor that the platform will meet your requirements or be available at any particular time or secure or free from errors or viruses.

9.8 User Remedies

Your sole and exclusive remedy in case of dissatisfaction with Homable or any of its services is to stop using the platform. If a court of competent jurisdiction deems any part of this Section 9 invalid or unenforceable, then the liability of Homable will be limited to the greatest extent permitted by law.

(The above liability provisions are crafted to be compliant with German law on limitation of liability and consumer protection. They do not affect any mandatory statutory rights you have, and are intended to exclude or limit liability only to the extent such exclusions are lawful.)

10. Right of Withdrawal (Widerrufsrecht)

10.1 Applicability for Consumers

If you are using Homable as a consumer (i.e., for purposes that are predominantly outside your trade, business, or profession), and you reside in the European Union or European Economic Area, you have a legal right to withdraw from the agreement you entered into with Homable (i.e., these Terms as a user contract) within 14 days without giving any reason. The provisions in this Section 10 explain your withdrawal rights as required by EU consumer law (specifically, pursuant to the German Civil Code sections implementing Directive 2011/83/EU on consumer rights).

Homable processes personal data in compliance with the EU General Data Protection Regulation (GDPR) and our Privacy Policy. You are informed of your data protection rights: in particular, you have the right to access, rectify or erase your personal data, to restrict or object to processing, to data portability, and to withdraw consent at any time. You also have the right to lodge a complaint with the appropriate data protection authority. Homable will respond to all such requests without undue delay.

Data Controller and Processing: Homable.de (operated by Nikita Mullovskii (Homable) -- Withdrawal Notice, Saarbruecker str.7, Berlin, 10405, Germany) is the data controller for personal data collected on this site. We collect and process your personal data only for specified, explicit and legitimate purposes (e.g. order fulfilment, customer service, legal compliance) and on lawful bases (performance of contract, legal obligations, or your consent). We implement appropriate technical and organizational measures to safeguard your data. We will inform you of the retention period (or the criteria for determining it) for each category of personal data. Where processing is based on consent, you may withdraw that consent at any time without affecting prior processing.

10.2 Withdrawal Period

The withdrawal period will expire 14 days from the day of the conclusion of the contract -- in other words, 14 days from the day you registered your account or otherwise accepted these Terms (since that is when the contract between you and Homable is formed for use of the service). If you create an account and begin using Homable, that usage does not take away your right to withdraw, as described below.

10.3 How to Exercise the Right

To exercise your right of withdrawal, you must inform us (Homable / Nikita Mullovskii) of your decision to withdraw from this contract by an unequivocal statement (e.g., a letter sent by post or e-mail). You may use the following contact for withdrawal notices:

You may also use the model withdrawal form provided at the end of these Terms, but it is not mandatory. If you choose, you can simply state in your own words (via email for speed) that you wish to withdraw from the Homable user contract, including your account information (username/email) to help us identify your account.

10.4 Timely Notice

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the 14-day period has expired. For example, sending the withdrawal email on the 14th day (before midnight in your time zone) would be considered timely.

10.5 Effects of Withdrawal

If you withdraw from this contract, we will deactivate and delete your Homable account and cease providing our service to you. Because the service was free of charge, there are no payments to refund. (If any paid services were utilized, which is not applicable at this time, we would handle refunds as required by law.) Upon withdrawal, we will also remove your personal data from our systems to the extent required by law (see Section 8 on data deletion), except for data we must keep for legal reasons. You will lose access to any listings or messages associated with your account, so if you need to keep any information, please save it before withdrawing.

10.6 Commencement of Services during Withdrawal Period

By registering and using Homable within the 14-day withdrawal period, you expressly request and agree that we begin providing the service to you immediately (i.e., you don't wish to wait until the end of the withdrawal period to start using Homable). This note is provided pursuant to Article 16 of the Consumer Rights Directive. This does not waive your right of withdrawal, but please note: if you fully utilize the service and then withdraw, you cannot demand reversal of services already rendered (since our service is free, this is a formality -- there is nothing to return except deletion of your data/account).

(Provision of the above information satisfies the requirements of German Civil Code for consumer withdrawal rights. If you have any questions about your right of withdrawal, you may contact us or consult your local consumer protection agency.)

11. Termination and Suspension

11.1 By User (Termination)

You have the right to stop using Homable at any time. If you wish to terminate your account, you can do so by using any account deletion function available or by contacting us via email (dmytro@homable.de) with a request to delete your account. Termination of your account will generally result in removal of your profile and any active listings from public view. Note that content or data which was public or shared (for example, messages you sent to other users, or information others have copied from your listing) cannot always be fully deleted by us -- we are not able to retract what other users already received or saved. However, your personal profile will no longer be accessible on Homable. After account deletion, we may retain certain data as outlined in Section 8.7 (for legal compliance or legitimate purposes), but it will no longer be accessible to you.

11.2 By Homable (Suspension or Termination)

Homable may suspend or terminate your account or access to the service if we reasonably believe that: (a) you have violated these Terms or any applicable law; (b) you have engaged in fraudulent or harmful behavior (e.g., posting fraudulent listings, scamming other users, posting illegal content); (c) you create risk or possible legal exposure for us; or (d) our provision of the Services to you is no longer commercially viable or feasible (for example, if we discontinue the platform). We will notify you of the reason for termination or suspension, unless legal reasons prevent us from doing so or we could risk liability or interference with law enforcement. In less severe cases, we will usually suspend (temporarily disable) an account to give you an opportunity to correct an issue, rather than permanently terminate, unless the violation is egregious or repeated. Account termination does not preclude us from taking further legal action if warranted by the circumstances (e.g., if severe damage or illegal activities are involved).

11.3 Effect of Termination by Homable

If your account is terminated by us, these Terms will cease to apply, except that the following sections will continue in effect: Section 4.9 (User Indemnity), Section 9 (Liability Limitations), any accrued rights to payment (though currently none, as service is free), and Section 13 (Governing Law) and Section 14 (Dispute Resolution), and Section 15 (Miscellaneous). If appropriate and allowed, we may provide you with a way to obtain a copy of any non-public content you have provided (e.g., your messages or data), but we reserve the right to delete your data per our standard retention policy. You are not allowed to create a new account if your prior account was terminated by us for violations; doing so may constitute a further violation and we reserve the right to block such re-registrations (for example by blocking your email or IP).

11.4 Survival

Any provisions of these Terms which by their nature should survive termination (such as indemnities, limitation of liability, dispute resolution, governing law, etc.) shall survive the termination or expiration of your agreement with Homable.

11.5 Discontinuation of Service

Because Homable is a beta service, there is a possibility that we may decide to shut down the platform entirely. Homable reserves the right to discontinue the offering of this service (either in whole or in part) at any time. If we anticipate a permanent shutdown, we will make reasonable efforts to inform active users in advance via the email on record and by posting a notice on the website. In the event of shutdown, all user accounts would be terminated, and users would no longer have access to the platform or their data on the platform. We would endeavor to provide a window for users to download or save any content or data (like their messages or listing info) before closure, to the extent feasible. Homable shall not be liable to you or any third party for any modification, suspension, or discontinuation of the service, provided that this does not affect any refunds due for paid services (again, not applicable in current free model).

12. Changes to These Terms

12.1 Right to Modify Terms

We may revise or update these Terms from time to time, especially as our service evolves or as laws change. For example, we may need to add new terms when we launch new features (such as payment integration or premium services), or to ensure compliance with updated legal requirements (like new regulations). We reserve the right to modify these Terms at any time.

12.2 Notification of Changes

If we make material changes to the Terms that affect your rights or obligations, we will provide you with clear notice in advance of the changes taking effect. Notice may be given by sending an email to the address associated with your account and/or by prominently posting a notice on the Homable website (for example, a banner or modal when you log in). The notice will outline the key changes and the effective date.

12.3 Acceptance of Changes

The updated Terms will become effective no sooner than 30 days from notification (or sooner if the changes are required by law to take effect earlier, in which case the notice will specify this). If you continue to use Homable after the new Terms take effect, you are deemed to have accepted the changes. If you do not agree to the revised Terms, you must stop using Homable and may delete your account before the changes apply. Continuing to use the service without deleting your account will indicate your acceptance of the updated Terms.

12.4 Minor Changes

Not all changes will be significant. Minor modifications, clarifications, or corrections that do not materially reduce your rights may take effect immediately without specific notice beyond posting the updated Terms on the site. However, we will not retroactively change dispute resolution provisions or other core parts of the Terms without notice to users who would be affected.

12.5 Keeping Updated

We encourage you to review these Terms periodically. We will update the "Last Updated" date at the top of the Terms whenever we make changes. For any questions about changes or to understand any new terms, feel free to contact us.

13. Governing Law and Jurisdiction

13.1 Governing Law

These Terms, and any dispute or claim (whether contractual or non-contractual) arising out of or in connection with them or your use of Homable, shall be governed by the laws of the Federal Republic of Germany, in particular under German civil law. The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply, as this is not a sale-of-goods transaction.

13.2 Consumer Protection Law

If you are a consumer residing in a country other than Germany, you may also be entitled to the protection of mandatory consumer protection provisions of your country of residence. Nothing in these Terms, including the choice of German law, affects your rights as a consumer to rely on such mandatory provisions of local law that are more beneficial to you. In essence, we will respect any non-waivable rights you have under local law.

13.3 Jurisdiction

For any disputes arising out of or related to these Terms or the Homable service:

  • If you are a business user (i.e., not a consumer), the exclusive place of jurisdiction shall be Berlin, Germany. We each agree to the courts of Berlin as the venue.
  • If you are a consumer, we will not require you to travel to a foreign jurisdiction for resolution of disputes. You may choose to bring a claim in the courts of Germany or in the courts of your country of habitual residence. Likewise, you may be sued in those courts by Homable (for example, if you have obligations under these Terms). In the absence of any overriding law dictating otherwise, the courts of Berlin, Germany will have non-exclusive jurisdiction.

13.4 Language of the Contract

The language of these Terms is English. We may provide translations of these Terms in other languages for convenience. In case of any inconsistencies or ambiguities between the English version and a translated version, the English version shall prevail in governing the relationship. However, nothing in this clause shall limit any rights you may have under law to receive certain information or contractual terms in the official language of your country (for example, German consumers may be provided a German version; we will do so when required).

14. Dispute Resolution and Consumer Conciliation

14.1 Initial Resolution Efforts

We value our users and aim to address any concerns or disputes amicably and efficiently. If you have any issue or dispute with Homable or the service, we encourage you to contact us first at dmytro@homable.de and attempt to resolve the matter informally. We will attempt in good faith to resolve the dispute through dialogue.

14.2 No Obligation for ADR Participation

According to Section 36 of the German Verbraucherstreitbeilegungsgesetz (VSBG), we are required to inform you about our stance on alternative dispute resolution. Homable (Nikita Mullovskii) is currently not obligated and not willing to participate in a dispute resolution procedure before a consumer arbitration board. In plain terms, this means we do not engage in the formal ADR processes with consumer conciliation bodies under the VSBG at this time. This decision does not affect your statutory rights; you still have the option to seek legal remedies through courts as described above, or to use other out-of-court mediation services if you prefer (but any such process would need mutual agreement to participate).

14.3 Online Dispute Resolution Platform

The European Commission provides an Online Dispute Resolution (ODR) platform for resolving disputes online. This platform can be found at https://ec.europa.eu/consumers/odr . The ODR platform is a centralized site that allows EU consumers and traders to reach out-of-court settlements for disputes arising from online transactions. While Homable is not a "trader" selling goods or services for a price, and thus many disputes related to property contracts will be outside the scope of that platform, we provide this link as a matter of EU regulatory requirement. Please note, as stated, that we do not commit to ADR; listing the ODR platform does not imply we will agree to use it in all cases, but it is an available resource for you.

14.4 Legal Remedies

If a dispute cannot be resolved amicably, you retain the right to seek redress in court, as outlined in Section 13. We hope to avoid that and solve issues cooperatively, but we want to be clear that nothing in these Terms will prevent you from accessing the judicial system to assert your claims.

14.5 Costs

Each party will bear its own costs incurred in any dispute, unless a legal authority decides otherwise. For example, if you choose to hire a lawyer to send us a letter, that is your cost. If a court awards costs or attorneys' fees to the prevailing party, that will be as per the court's judgment.

15. Miscellaneous Provisions

15.1 Entire Agreement

These Terms (including any documents incorporated by reference, such as the Privacy Policy once available, and any additional guidelines or rules on the platform) constitute the entire agreement between you and Homable regarding your use of the service. They supersede any prior agreements or communications (whether oral or written) between you and us with respect to the subject matter. Each party acknowledges that, in entering into this agreement, it has not relied on any representation or warranty not explicitly stated in these Terms.

15.2 Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a competent court or authority, that provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable. If such modification is not possible, the relevant provision shall be deemed severed from these Terms. In either case, the remaining provisions of the Terms will remain in full force and effect. The invalid/unenforceable provision will, where appropriate, be replaced by a valid provision that comes closest to the intended economic purpose of the original provision.

15.3 No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of future enforcement of that right or provision. The waiver of any breach shall not waive any other breach. In order for any waiver of compliance with these Terms to be binding, Homable must provide you with written notice of such waiver through one of its authorized representatives.

15.4 Assignment

You may not assign or transfer any of your rights or obligations under these Terms to a third party without our prior written consent. Homable may freely assign or transfer these Terms (in whole or in part) as part of a reorganization, merger, sale, or transfer of assets, or by operation of law or otherwise. These Terms shall bind and inure to the benefit of the parties, their successors, and permitted assigns.

15.5 Relationship of Parties

Nothing in these Terms shall be construed to create a partnership, joint venture, employment, or agency relationship between you and Homable. Neither party has the authority to bind or incur obligations on behalf of the other.

15.6 Third-Party Beneficiaries

These Terms do not confer any rights on any third party, except where expressly stated. For instance, the indemnification clause (if any) might cover our affiliates or others; aside from such instances, no person other than the signatories to this contract (you and Homable) shall have any rights to enforce any term of this contract.

15.7 Notices

We may provide notices or communications to you by email (to the address associated with your account), through the Homable platform (e.g., notifications in your user dashboard or banners/alerts on the site), or by mail (if you provided a physical address). You are responsible for keeping your contact information up-to-date. Official legal notices to Homable should be sent to the postal address in Section 1.2 (Impressum address) with a copy emailed to dmytro@homable.de, and should be clearly marked as legal notice.

15.8 Force Majeure

Homable shall not be liable for any delay or failure in performance of the platform or services resulting from events or circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, strikes or labor disputes, electrical outages, interruptions of telecommunications or internet service, pandemic or governmental action.

15.9 Headings

The section titles and headings in these Terms are for convenience only and have no legal or contractual effect. However, we have used them to make the document easier to read and navigate, consistent with our aim of clear and user-friendly language.
